End User License Agreement (EULA)

1. Agreement to Terms

This End User License Agreement ("EULA") is a binding legal agreement between you ("User" or "you") and İkram ("we," "us," or "our"). By downloading, installing, or using the İkram mobile application, you agree to be bound by the terms of this EULA.

If you do not agree to this EULA, do not download, install, or use the application.

This EULA supplements, and should be read in conjunction with, our:

Subject to your compliance with this EULA, İkram grants you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and install the İkram application on a compatible device that you own or control
  • Use the application for your personal, non-commercial purposes

This license is granted solely for your use and does not grant you any rights to resell, redistribute, or commercialize the application.

3. License Restrictions

You agree NOT to:

3.1 Prohibited Technical Activities

  • Reverse Engineer: Decompile, disassemble, reverse engineer, or attempt to derive the source code of the application
  • Modify: Create derivative works, modifications, or adaptations of the application
  • Copy: Copy the application except for backup purposes
  • Distribute: Rent, lease, lend, sell, redistribute, or sublicense the application
  • Remove Notices: Remove, alter, or obscure any proprietary notices (copyright, trademark) from the application

3.2 Prohibited Usage

  • Use the application for any unlawful purpose
  • Use the application in any way that violates our Terms of Service
  • Interfere with or disrupt the application or servers
  • Attempt to gain unauthorized access to any part of the application
  • Use automated scripts, bots, or crawlers to access the application

4. Ownership and Intellectual Property

4.1 İkram Ownership

İkram retains all right, title, and interest in and to the application, including:

  • All intellectual property rights (copyrights, trademarks, patents)
  • The application's design, structure, organization, and source code
  • All updates, enhancements, and modifications

This EULA does NOT transfer any ownership rights to you.

4.2 User Content

You retain ownership of the content you create and upload to İkram (recipes, photos, videos). However, by posting content, you grant İkram a license as described in our Terms of Service.

4.3 Third-Party Components

The application may include third-party software components governed by separate licenses. These components are listed in the app under "Settings > About > Open Source Licenses."

5. Updates and Modifications

5.1 Automatic Updates

İkram may automatically download and install updates to the application. These updates may include:

  • New features and functionality
  • Bug fixes and performance improvements
  • Security patches
  • Changes to comply with legal requirements

By using the application, you consent to these automatic updates.

5.2 Changes to Features

We reserve the right to:

  • Modify or discontinue any feature of the application
  • Change the availability of the application in certain regions
  • Require you to accept updated terms to continue using the application

We will provide notice of significant changes through the application or via email.

5.3 No Guarantee of Backward Compatibility

Updates may change how the application works and may not be compatible with older versions. We do not guarantee backward compatibility with previous versions.

6. Device Requirements and Compatibility

6.1 Minimum Requirements

To use İkram, you must have:

  • iOS: iPhone running iOS 13.4 or later
  • Internet Connection: Active internet connection (Wi-Fi or cellular data)
  • Storage: Sufficient device storage for the application and user content
  • Permissions: Grant required permissions (camera, photo library, notifications)

6.2 Compatibility

We strive to support the latest devices and operating systems. However:

  • We do not guarantee compatibility with all devices
  • Older devices may experience reduced functionality or performance
  • We may discontinue support for older operating system versions

6.3 Data Charges

Using İkram may consume data. You are responsible for any data charges from your mobile carrier.

7. Subscription and Payment Terms

7.1 Free Service

İkram is currently a free service. You are not required to pay any fees to use the core features of the application.

7.2 Future Premium Features

We may introduce premium features or subscription plans in the future. If we do:

  • We will provide clear notice before charging you
  • You will have the option to opt-in to premium features
  • Separate subscription terms will apply
  • Free users will continue to have access to core features

7.3 In-App Purchases

If we introduce in-app purchases:

  • All purchases are processed through the Apple App Store or Google Play Store
  • Refund policies are governed by the respective app store
  • You are responsible for all purchases made through your account

8. App Store-Specific Terms

8.1 Apple App Store Terms

If you download İkram from the Apple App Store, the following terms apply:

Acknowledgements:

  • This EULA is between you and İkram, not Apple
  • Apple is not responsible for the application or its content
  • Apple has no warranty obligations with respect to the application
  • Apple is not responsible for addressing any claims relating to the application, including:
    • Product liability claims
    • Claims that the application fails to conform to legal requirements
    • Claims arising under consumer protection laws

Third-Party Beneficiary:

  • Apple is a third-party beneficiary of this EULA
  • Apple has the right to enforce this EULA against you

Usage Rules:

  • You must comply with the Apple Media Services Terms and Conditions
  • You may only use the application on Apple-branded devices that you own or control
  • You may not use the application on jailbroken devices

8.2 Google Play Store Terms

If you download İkram from the Google Play Store:

  • You must comply with the Google Play Terms of Service
  • Refunds are governed by Google Play's refund policy
  • Google is not responsible for the application or any claims relating to it

9. Termination

9.1 Termination by You

You may terminate this EULA at any time by:

  • Deleting the application from your device
  • Deleting your İkram account

9.2 Termination by İkram

We may terminate or suspend your license at any time if:

  • You violate this EULA or our Terms of Service
  • You engage in fraudulent or illegal activity
  • We discontinue the application (with reasonable notice)

9.3 Effect of Termination

Upon termination:

  • Your license to use the application immediately ceases
  • You must delete the application from all your devices
  • We may delete your account and data
  • Sections 4 (Ownership), 10 (Disclaimers), 11 (Limitation of Liability), and 12 (Indemnification) survive termination

10. Disclaimers and No Warranties

10.1 "AS IS" Provision

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability: No warranty that the application is suitable for your purposes
  • Fitness for a Particular Purpose: No warranty that the application will meet your specific needs
  • Non-Infringement: No warranty that the application does not infringe third-party rights
  • Quality: No warranty regarding the quality, accuracy, or reliability of the application
  • Uninterrupted Service: No warranty that the application will be error-free or uninterrupted

10.2 User Content Disclaimer

We do not endorse, verify, or take responsibility for user-generated content, including recipes, photos, or comments. Use all user content at your own risk.

10.3 Food Safety Disclaimer

CRITICAL NOTICE:

İkram is a platform for sharing food content. We do NOT:

  • Verify the safety or accuracy of recipes
  • Check for allergens or dietary information
  • Guarantee nutritional information
  • Endorse any specific cooking methods or recipes

YOU ASSUME ALL RISKS associated with using recipes from the application. Consult healthcare professionals for dietary and allergy concerns.

10.4 No Medical or Dietary Advice

İkram does not provide medical, nutritional, or dietary advice. Information on the application is for general informational purposes only.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

11.1 No Liability for Damages

İKRAM SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Personal injury or property damage arising from your use of the application
  • Damage to your device caused by the application
  • Food-related injuries or illnesses from using recipes in the application
  • Data loss or corruption

11.2 Maximum Liability Cap

If we are found liable despite the above limitations, our total liability shall not exceed:

  • The amount you paid us in the 12 months before the incident, or
  • $100 USD (whichever is greater)

11.3 Jurisdictional Variations

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless İkram, its affiliates, officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the application
  • Your violation of this EULA
  • Your violation of any third-party rights
  • Content you post on the application
  • Your violation of any laws or regulations

13. Export Compliance

You represent and warrant that:

  • You are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country
  • You are not listed on any U.S. government list of prohibited or restricted parties
  • You will comply with all applicable export and re-export control laws and regulations

14. Governing Law and Dispute Resolution

14.1 Governing Law

This EULA is governed by the laws of Delaware, United States, without regard to its conflict of law provisions.

14.2 Dispute Resolution

Before initiating any legal action, you agree to first contact us at legal@ikramrecipes.com to attempt to resolve the dispute informally.

14.3 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Delaware, United States for the resolution of any disputes.

15. General Provisions

15.1 Entire Agreement

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and İkram regarding the application.

15.2 Amendments

We may modify this EULA at any time. We will notify you of significant changes by:

  • Posting an updated EULA in the application
  • Sending an email to your registered address
  • Displaying a notice when you next use the application

Your continued use after modifications constitutes acceptance of the updated EULA.

15.3 Severability

If any provision of this EULA is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.4 Waiver

Our failure to enforce any provision of this EULA does not constitute a waiver of that provision.

15.5 Assignment

You may not assign this EULA without our written consent. We may assign our rights and obligations under this EULA without restriction.

15.6 No Third-Party Beneficiaries

This EULA does not create any third-party beneficiary rights, except as explicitly stated in Section 8.1 (Apple as third-party beneficiary).

15.7 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government actions).

BY DOWNLOADING, INSTALLING, OR USING THE İKRAM APPLICATION, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS END USER LICENSE AGREEMENT.
