1. Acceptance of Terms

Welcome to İkram! These Terms of Service ("Terms") govern your access to and use of the İkram mobile application, including any content, functionality, and services offered through the app.

By creating an account, accessing, or using İkram, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use İkram.

IMPORTANT:

  • You must be at least 13 years old to use İkram
  • By using İkram, you represent that you meet this age requirement
  • If you are under 18, you represent that you have your parent or guardian's permission to use İkram

2. About İkram

İkram is a social media platform dedicated to food enthusiasts. Our service allows users to:

  • Discover and explore recipes from around the world
  • Share your own recipes, photos, and cooking videos
  • Follow chefs, home cooks, and food content creators
  • Interact with a community through likes, comments, and saves
  • Organize recipes into collections and meal plans

3. User Accounts

3.1 Account Creation

To use İkram, you must create an account by providing:

  • A valid email address
  • A display name (username)
  • A secure password
  • Date of birth (to verify age requirements)

You agree to provide accurate, current, and complete information during registration and to update such information as needed.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your password
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We will never ask you for your password. Do not share your password with anyone.

3.3 Account Termination

You may delete your account at any time through the app settings. Upon deletion:

  • Your personal information will be removed within 90 days
  • Your recipes and content may remain visible if they were shared publicly (unless you delete them first)
  • Some data may be retained for legal or security purposes

We reserve the right to suspend or terminate your account if you violate these Terms.

4. User-Generated Content

4.1 Your Content

When you post content on İkram (recipes, photos, videos, comments, etc.), you retain all ownership rights to your content.

However, by posting content, you grant İkram a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your content in connection with operating and providing the service.

This license includes the right to:

  • Display your content to other İkram users
  • Include your content in search results and recommendations
  • Share your content on social media (if you use share features)
  • Use your content for promotional purposes (with attribution)

4.2 Content Guidelines

You agree that your content will NOT include:

Illegal Content:

  • Anything that violates local, state, national, or international laws
  • Content that promotes illegal activities

Harmful Content:

  • Hate speech, harassment, or discrimination
  • Violence, gore, or graphic content
  • Sexual or nude content
  • Content that promotes self-harm or eating disorders

Deceptive Content:

  • Spam, scams, or phishing attempts
  • Misleading information or clickbait
  • Impersonation of others
  • False or deceptive recipes intentionally designed to cause harm

Intellectual Property Violations:

  • Content you don't have the right to share
  • Copyrighted recipes, photos, or videos without permission
  • Plagiarized content

Dangerous Food Content:

  • Recipes that are deliberately unsafe or harmful
  • Misleading allergy or dietary information intended to deceive
  • Content promoting unsafe food handling practices

4.3 Content Moderation

İkram reserves the right to:

  • Remove content that violates these Terms
  • Suspend or ban users who repeatedly violate our guidelines
  • Report illegal content to law enforcement

We are not obligated to monitor all user content, but we may do so to enforce these Terms.

4.4 DMCA Copyright Policy

İkram respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond to valid notices of copyright infringement and will terminate the accounts of repeat infringers.

Filing a DMCA Takedown Notice:

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible on İkram, you may notify our designated DMCA agent by providing the following information in writing:

  1. Identification of the copyrighted work claimed to have been infringed (or if multiple works, a representative list)
  2. Identification of the infringing material and information sufficient to locate it on İkram (e.g., specific recipe URL, user profile link)
  3. Your contact information, including name, address, telephone number, and email address
  4. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner
  6. Your physical or electronic signature

Counter-Notification:

If you believe that your content was removed by mistake or misidentification, you may file a counter-notification containing:

  1. Your contact information
  2. Identification of the removed content and its former location
  3. A statement under penalty of perjury that the content was removed by mistake or misidentification
  4. Your consent to the jurisdiction of federal court in your district
  5. Your physical or electronic signature

We will forward your counter-notification to the original complainant. If they do not file a lawsuit within 10 business days, we may restore your content.

Repeat Infringer Policy:

İkram will terminate the accounts of users who are determined to be repeat infringers. We track DMCA complaints and may terminate accounts after multiple valid complaints, even if the user removes the infringing content.

Important Notice About User Content:

İkram is a platform for user-generated content. We do not review, verify, or claim ownership of recipes, photos, or videos posted by users. All content posted by users is the sole responsibility of the user who posted it, not İkram.

4.5 Important: İkram Does Not Appropriate Your Content!

We want to make this absolutely clear:

İkram does NOT claim ownership of your recipes, photos, videos, or any content you create. When you post on İkram:

  • You retain full ownership of your original content
  • You maintain all copyright to your creative works
  • You control your content and can delete it at any time
  • We only ask for permission to display and distribute your content as necessary to operate the service (as described in Section 4.1)

The license you grant us is purely operational—it allows us to show your recipes to other users, include them in search results, and enable the social features of the app. This does NOT mean we own your content or can use it outside of operating İkram.

Your Content, Your Rights:

  • Recipe creators are credited for their work
  • You can request removal of your content at any time
  • We will never sell your recipes or claim them as our own
  • If we want to feature your content in marketing or promotions, we will ask for explicit permission first

Third-Party Content:

If you share content from cookbooks, food blogs, restaurant recipes, or other copyrighted sources, you are responsible for ensuring you have the right to share that content. İkram assumes no responsibility for copyright infringement committed by users.

5. Prohibited Activities

You agree NOT to:

Technical Abuse:

  • Access İkram through automated means (bots, scrapers, crawlers)
  • Attempt to gain unauthorized access to our systems
  • Reverse engineer, decompile, or disassemble the app
  • Interfere with or disrupt the service or servers
  • Bypass security features or access restrictions

User Abuse:

  • Harass, bully, or threaten other users
  • Stalk or collect personal information about others
  • Impersonate others or misrepresent your affiliation
  • Spam users with unwanted messages or content

Commercial Abuse:

  • Use İkram for unauthorized commercial purposes without our consent
  • Sell, rent, or lease access to your account
  • Advertise or promote third-party products without permission

System Abuse:

  • Create multiple accounts to manipulate features or evade bans
  • Engage in vote manipulation or fake engagement
  • Use the service to distribute malware or viruses

6. Intellectual Property Rights

6.1 İkram's Intellectual Property

İkram and its original content (excluding user content), features, and functionality are owned by İkram and are protected by:

  • Copyright laws
  • Trademark laws
  • Other intellectual property rights

You may not:

  • Copy, modify, or create derivative works of İkram
  • Use our trademarks without permission
  • Remove or alter any copyright or trademark notices

6.2 User Content Ownership

You retain all rights to the content you post on İkram. However, the license you grant us (Section 4.1) allows us to operate the service effectively.

6.3 Feedback

If you provide us with feedback, suggestions, or ideas about İkram, you grant us the right to use them without compensation or obligation to you.

7. Privacy and Data Protection

Your use of İkram is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using İkram, you consent to:

  • Our collection and use of your data as described in the Privacy Policy
  • The storage of your data on our servers
  • The transfer of your data as necessary to provide the service

8. Disclaimers and Warranties

8.1 "As-Is" Service

İkram is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, including:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the service will be uninterrupted or error-free
  • Warranties regarding the accuracy or reliability of content

8.2 User Content Disclaimer

İkram is a platform for user-generated content. We do not:

  • Verify the accuracy of recipes or food content
  • Endorse or recommend any specific recipes
  • Guarantee the safety of recipes
  • Verify nutritional information
  • Check for allergens or dietary compliance

YOU USE RECIPES AT YOUR OWN RISK.

8.3 Food Safety and Recipe Disclaimer

CRITICAL FOOD SAFETY AND RECIPE NOTICE:

İkram is a user-generated content platform. All recipes, cooking instructions, and food-related content are created by users, not by İkram. We do not verify, test, endorse, or guarantee any recipes or food content.

İkram is NOT responsible for:

Health and Safety Risks:

  • Food allergies or intolerances: Recipes may contain undeclared allergens (nuts, dairy, gluten, shellfish, etc.). Always verify ingredients yourself.
  • Foodborne illnesses: We do not verify food safety, proper cooking temperatures, or safe food handling practices.
  • Food poisoning: Improper food storage, preparation, or cooking can cause serious illness or death.
  • Nutritional accuracy: User-provided nutritional information may be incomplete, outdated, or incorrect.
  • Cooking injuries: Cooking involves inherent risks including burns, cuts, and other injuries.
  • Special dietary needs: Medical conditions (diabetes, celiac disease, kidney disease, etc.) require professional medical guidance.
  • Medication interactions: Some foods may interact with medications. Consult your doctor.
  • Pregnancy and infant feeding: Pregnant individuals and parents should consult healthcare providers before trying new recipes.

Recipe Accuracy and Originality:

  • Recipe authenticity: Users may post recipes that are not original, not properly attributed, or copied from copyrighted sources.
  • Recipe accuracy: Measurements, cooking times, and instructions may be incorrect or incomplete.
  • Cultural appropriation: Recipes claiming to represent specific cuisines or cultures may be inaccurate or offensive.
  • Proprietary recipes: Some recipes may be protected by copyright, trade secrets, or other intellectual property rights. Users are responsible for ensuring they have the right to share recipes.
  • "Secret" or "signature" recipes: Users may post recipes that belong to restaurants, chefs, food companies, or other third parties without authorization.

YOUR RESPONSIBILITY:

  • YOU ASSUME ALL RISK when preparing or consuming recipes found on İkram
  • Always verify ingredients for allergens and dietary restrictions
  • Follow safe food handling practices from reputable sources (CDC, FDA, USDA)
  • Use common sense and consult professionals when in doubt
  • Research recipes from multiple sources before attempting complex or unfamiliar dishes
  • Check for copyright if you suspect a recipe may be proprietary

If you have food allergies, dietary restrictions, medical conditions, or health concerns, consult a licensed medical professional or registered dietitian before trying new recipes. İkram is NOT a substitute for professional medical or nutritional advice.

DISCLAIMER: İkram does not guarantee the safety, accuracy, authenticity, or originality of any user-generated recipe content. By using İkram, you acknowledge that you assume all risks associated with preparing and consuming recipes found on the platform.

8.4 Third-Party Content and Links

İkram may contain links to third-party websites or services. We are not responsible for:

  • The content or privacy practices of third-party sites
  • Products or services offered by third parties
  • Interactions with third-party services

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

İkram, its owners, employees, and affiliates shall NOT be liable for any:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, data, or goodwill
  • Personal injury or property damage resulting from your use of İkram
  • Damages arising from user content or third-party content
  • Damages from unauthorized access to your account

MAXIMUM LIABILITY:

If we are found liable, our total liability shall not exceed:

  • The amount you paid us in the 12 months before the claim, or
  • $100 USD (whichever is greater)

JURISDICTIONAL LIMITATIONS:

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

10. User Indemnification

YOU AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS İkram, its owners, employees, contractors, affiliates, and service providers from any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from:

Your Use of İkram:

  • Your access to or use of the İkram platform
  • Your violation of these Terms of Service
  • Your violation of any applicable laws or regulations

Your Content:

  • Copyright infringement: Any content you post that infringes on third-party copyrights, trademarks, or other intellectual property rights
  • Patent infringement: Sharing proprietary recipes, cooking methods, or techniques that are protected by patents or trade secrets
  • Proprietary recipes: Posting restaurant signature dishes, chef's secret recipes, or copyrighted cookbook recipes without authorization
  • Trade secret violations: Sharing confidential recipes, formulas, or techniques from food companies or culinary professionals
  • False attribution: Claiming credit for recipes you did not create or failing to properly attribute sources
  • Plagiarism: Copying recipes, photos, videos, or text from other sources without permission

Harm to Others:

  • Your violation of any third-party rights, including privacy rights, publicity rights, or intellectual property rights
  • Any claims that your content caused harm, injury, illness, or death to another person
  • Food safety violations, undisclosed allergens, or dangerous cooking instructions in your content
  • Harassment, defamation, or other harmful conduct toward other users

Third-Party Claims:

  • Any claim by a third party (individuals, companies, copyright holders, etc.) related to your use of İkram or content you posted
  • DMCA takedown notices or copyright infringement claims related to your content
  • Claims by chefs, restaurants, food companies, or cookbook authors regarding proprietary recipes

This means:

  • You are financially responsible for legal costs if someone sues İkram because of your content
  • You must pay İkram's legal fees if we are sued because you posted copyrighted or proprietary content
  • You are solely liable for any copyright, patent, or trade secret violations in your content
  • İkram is not responsible for investigating whether your recipes are original or properly authorized

We strongly encourage you to:

  • Only post original recipes you created yourself
  • Properly attribute and credit recipes adapted from other sources (when you have permission)
  • Do not post exact copies of copyrighted recipes from cookbooks, restaurants, or food blogs
  • Respect intellectual property rights of chefs, restaurants, and food companies

11. Dispute Resolution

11.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles.

11.2 Informal Resolution

Before filing a claim, please contact us at support@ikramrecipes.com to seek informal resolution. Most disputes can be resolved quickly and amicably.

11.3 Jurisdiction and Venue

Any legal action arising from these Terms shall be brought in the courts of Delaware, United States. You consent to the exclusive jurisdiction of such courts.

12. Modifications to Terms

12.1 Changes

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

  • Sending an email to your registered address
  • Posting a notice in the app
  • Updating the "Last Updated" date

12.2 Your Acceptance

Your continued use of İkram after changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using İkram and delete your account.

12.3 Version History

  • Version 1.1 (January 26, 2025): Enhanced copyright protection, added comprehensive DMCA policy, strengthened user indemnification, expanded food safety disclaimers

13. Termination

13.1 Termination by You

You may terminate your account at any time by:

13.2 Termination by İkram

We may suspend or terminate your account immediately if you:

  • Violate these Terms
  • Engage in fraudulent or illegal activities
  • Harm other users or the service
  • Create multiple accounts to evade bans

13.3 Effect of Termination

Upon termination:

  • Your right to use İkram immediately ceases
  • We may delete your content and data
  • Sections 4.1 (Content License), 8 (Disclaimers), 9 (Limitation of Liability), and 10 (Indemnification) survive termination

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or policies on İkram, constitute the entire agreement between you and İkram.

14.2 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

14.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.

15. App Store-Specific Terms

15.1 Apple App Store

If you download İkram from the Apple App Store, you agree that:

  • These Terms are between you and İkram, not Apple
  • Apple is not responsible for İkram or its content
  • Apple has no obligation to provide maintenance or support for İkram
  • Apple is not responsible for any product liability claims
  • Apple is not responsible for addressing any claims relating to İkram
  • Apple is a third-party beneficiary of these Terms and may enforce them

15.2 End User License Agreement (EULA)
